Welcome to TVET Job Board. These Terms of Service ("Terms") govern your access to and use of our website, services, and applications (collectively, the "Services"). Please read these Terms carefully before using our Services.

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

1. Acceptance of Terms

By creating an account, accessing, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Eligibility

To use our Services, you must be at least 18 years old and capable of forming a binding contract. If you are accessing the Services on behalf of an organization, you must have the legal authority to bind that organization to these Terms.

3. Account Registration

To access certain features of our Services, you may need to create an account. When you register, you agree to provide accurate, current, and complete information about yourself and to update this information to maintain its accuracy.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

4. User Types and Specific Terms

4.1 Students and Job Seekers

If you register as a student or job seeker, you:

• Represent that all information provided in your profile and applications is truthful and accurate
• Grant us permission to share your profile information with potential employers when you apply for jobs
• Agree not to create multiple accounts or misrepresent your qualifications
• Understand that we do not guarantee job placement or employment

4.2 Employers and Recruiters

If you register as an employer or recruiter, you:

• Agree to provide accurate information about your company and job opportunities
• Will not discriminate against applicants based on race, color, religion, gender, sexual orientation, national origin, disability, age, or any other legally protected status
• Will use applicant information solely for recruitment purposes and in compliance with applicable laws
• Understand that we do not guarantee applicants or successful hiring outcomes

5. User Content

Our Services allow you to post, upload, store, share, send, or display content, including but not limited to text, images, videos, resumes, job postings, and company profiles ("User Content").

You retain ownership rights in your User Content. However, by posting User Content, you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, copy, modify, create derivative works based on, distribute, publicly display, and otherwise exploit such User Content in connection with operating and providing our Services.

You represent and warrant that:

• You own or have the necessary rights to your User Content
• Your User Content does not violate the rights of any third party, including intellectual property rights and privacy rights
• Your User Content complies with these Terms and all applicable laws and regulations

6. Prohibited Conduct

You agree not to:

• Use the Services for any illegal purpose or in violation of any laws or regulations
• Post or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity
• Interfere with or disrupt the Services or servers or networks connected to the Services
• Attempt to gain unauthorized access to any part of the Services or any accounts, computer systems, or networks connected to the Services
• Harvest or collect email addresses or other contact information of other users from the Services
• Use the Services to send unsolicited communications, promotions, or advertisements
• Use automated means, including spiders, robots, crawlers, or data mining tools, to access the Services or collect content from the Services

7. Intellectual Property Rights

The Services and their contents, features, and functionality, including but not limited to text, graphics, logos, icons, images, audio clips, software, and the design, selection, and arrangement thereof, are owned by us, our licensors, or other providers and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms do not grant you any right, title, or interest in the Services or our content, nor any intellectual property rights except for the limited license to use the Services in accordance with these Terms.

8. Subscription and Payment Terms

Some of our Services may require payment of fees. If you choose a paid subscription:

• You agree to pay all fees in accordance with the pricing and payment terms presented to you
• You authorize us to charge your designated payment method for these fees
• All payments are non-refundable except as expressly provided in these Terms or as required by law
• We may change our fees at any time with notice to you

9. Termination

We may terminate or suspend your account and access to the Services at any time, without prior notice or liability, for any reason, including if you breach these Terms.

You may terminate your account at any time by following the instructions on our website or by contacting us.

Upon termination, your right to use the Services will immediately cease, and we may delete or remove your account and any content associated with it.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES OR THE SERVERS THAT MAKE THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE, OUR AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICES.

12. Indemnification

You agree to indemnify, defend, and hold harmless us, our affiliates, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Services, your User Content, or your violation of these Terms.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the Nairobi Centre for International Arbitration. The arbitration shall be conducted in Nairobi, Kenya, in the English language.

14. Changes to Terms

We may modify these Terms at any time by posting the revised Terms on our website. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.

16. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on the Services, constitute the entire agreement between you and us concerning the Services.
